1. Data we collect and reasons for collection

We collect and use some personal data that belongs to those who use our website. In doing so, we act as controller of this data and we are bound to the provisions of Federal Law n. 13.709/2018 (General Law of Personal Data Protection – GLPDP).

We take care of your personal data protection and, for that, we provide this privacy policy, that contains important information about:

- Your rights in relation to your personal data; and

The company will store the information collected on its own servers or servers contracted by the company in the cloud by the service providers contracted by ZAMBIANCO.


The collection of these data takes place at the following occasions:

- When the user uses and fills out the contact form;

- When the user fills out the form in the “Holder’s Portal”;

- When the user requests service through Whatsapp Business.


1.2. - Sensitive Data

Sensitive data from our users will not be collected, thus understood by those defined in the arts. 11 et seq. of the Personal Data Protection Law. Thus, there will be no collection of data about racial or ethnic origin, religious conviction, political opinion, affiliation to a union or organization of a religious, philosophical and political nature, data relating to health or sexual life, genetic or biometric data, when linked to a natural person.


1.3. - Cookies

Cookies are small text files that are automatically downloaded to your device when you access and browse a website. They basically serve to identify devices, activities and user preferences.

The cookies do not allow any file or information to be extracted from the user’s hard drive, not being possible, even though, through them, the access to personal information that does not come from the users or the way they use the website resources.

4. Collection of data not expressly provided

Occasionally, other types of data not expressly provided for in this Privacy Policy may be collected, as long as they are provided with the user’s consent or that the collection is allowed based on another legal basis provided by law.

In any case, the data collection and the processing activities arising from it will be informed to the website users.

2. Sharing personal data with third-parties

We do not share your personal data with third-parties. Despite this, it is possible that we do so to comply with a legal or regulatory determination, or even, but not limited to:

ii. Investigate, prevent and take action related to cooperation with public bodies or to protect national security;

iii. Execution of contracts;

iv. Investigation and defense of third-party claims;

v.  Protection of the security or integrity of services.

3. How long will your personal data be stored

The personal data collected by the websites are stored and used for a period of time that corresponds to what is necessary to achieve the purposes listed in this document and considers the right of its holders, the rights of the website controller and the applicable legal or regulatory provisions.

Once the storage periods for personal data have expired, they are removed from our databases or anonymized, except in cases where there is a possibility or need for storage due to legal or regulatory provision.

4. Legal basis for the processing of personal data

Each operation for processing personal data must have a legal basis, that is, a legal basis, which is nothing more than a justification that authorizes it, provided for in the General Law of Personal Data Protection.

  • Contract execution or preparation;

  • Regular exercise of rights;

  • Protection of life and physical safety;

  • Holder’s health supervisory;

  • Credit protection.

5. User’s rights as data holder

In compliance with the applicable regulations, regarding the processing of personal data, Zambianco Group respect and guarantees the Users the possibility of submitting requests based on the following rights:

i) confirmation of the processing existence;

ii) access to data;

iii) correction of incomplete, inaccurate or outdated data;

iv) anonymization, blocking or elimination of unnecessary, excessive or non-conforming data;

v) the portability of your data to another service or product provider, upon express request by the User;

vi) the removal of processed data with the User’s consent;

vii) obtaining information about the public or private entities with which Zambianco Group shared its data;

viii) information about the possibility of not providing your consent, as well as being informed about the consequences, in case of refusal;

ix) revocation of consent.

Zambianco Group will make every effort to meet such requests in the shortest possible time, but reserving the right of the period determined by Law.

It is important to highlight that, under the terms of the GLPDP, there is no right to delete data processed on legal basis different from the consent, unless the data is unnecessary, excessive or processed in disagreement with the law.


5.1- How the holder can exercise their rights

The holders of personal data processed by us will be able to exercise their right through the form provided in the following way: Alternatively, if you want to, the holder may send an e-mail or a mail to our Personal Data Protection Officer. The information you need for this will be in the “How to contact us” section of this Privacy Policy.

The holders of personal data processed by us may exercise their rights by sending a message to our Personal Data Protection Officer, either by email or mail. The information you need to do this in the “How to contact us” section of this Privacy Policy.

To ensure that the user who intends to exercise their rights is, in fact, the personal data owner that are the object of the request, we may request documents or other information that can help your correct identification, in order to preserve our rights or our third-parties’ rights. This will only be done, however, if absolutely necessary, and the applicant will receive all related information.

6. Data we collect and reasons for collection

We employ technical and organizational measures capable of protecting personal data from unauthorized accesses and from situations of destruction, loss, misplacement or alteration of this data.

The measures we use consider the nature of the data, the context and purpose of the processing, the risks that a possible violation would generate for the user’s rights and freedom and the currently standards used in the market by companies similar to ours.

Among the security measures adopted by us, we highlight the following:

The Zambianco Group uses reasonable market means and legally required to preserve the privacy of the data collected. In this way, take, for example, the following precautions:

  1. When necessary, Zambianco Group uses standard and market methods to encrypt and anonymize the data collected;

  2. Zambianco Group has protection agains unauthorized access to its systems;

  3. Zambianco Group only authorizes the access of previously established people to the place where the collected information is stored;

  4. Those who comes into contact with the information undertake to maintain absolute confidentiality. The breach of confidentiality will result in civil liability and the person responsible will be held in accordance with Brazilian legislation; and


Even if you adopt everything in your power to avoid security incidents, it is possible that there may be a problem exclusively caused by a third-party – such as in cases of hackers or crackers attack, or, even in cases of the user’s sole fault, that occurs, for example, when they themselves transfer their data to a third-party. Thus, although we are, in general, responsible for the personal data that we process, we disclaim responsibility in case of some exceptional situation like these happen, over which we have no control.


For this reason, we encourage Users to take appropriate measures to protect themselves, such as keeping all created usernames and passwords confidential.

In any way, in case any security incident happens that could generate relevant risks or damage to any of our users, we will communicate those affected and the National Data Protection Authority about what happened, in accordance with the provisions of the General Law of Data Protection.


7. Complaint to a control authority

Without the loss of any other means of administrative and judicial appeal, the personal data holders who feel, in anyhow, that have been harmed, may file a complaint with the National Data Protection Authority, as long as you have contacted the company directly in order to solve your doubts or questions. According to ANPD guidelines, only requests formally presented to the data controller that have not been answered should be forwarded to the agency.

8. Changes to this policy

The current version of this Privacy Policy was last updated on: 03/01/2022.

We reserve the right to modify, at any moment, the current rules, especially to adapt them to any changes made to our website, whether by making new features available or by suppressing or modifying existing ones.


Whenever there is an adjustment, our users will be notified about the change.
